RULES & REGULATIONS FOR PERFORMING IN THE TAGORE THEATRE AUDITORIUM

1.AVAILABLITILY OF SCHEDULE OF SHOW/ SESSION
(a) There will be two time slots in a day as under:
  • (i) First Time Slot will start from 10.00 AM to 02.00 PM. The TAGORE THEATRE AUDITORIUM will be handed over to the party only two and a half hours before the show time for preparations. The party will have to vacate the TAGORE THEATRE AUDITORIUM immediately after the performance of show, but before 3:00 PM in any case. Show will not be allowed to run for more than one extra hour under any circumstances for which extra rent is to be paid.
  • (ii) Second Time Slot will start from 06.00 PM to 10PM. The TAGORE THEATRE AUDITORIUM will be handed over to the party only two and a half hours before the show time for preparations. The party will have to vacate the TAGORE THEATRE AUDITORIUM immediately after the performance of show, but before 11:00 PM in any case. Show will not be allowed to run for more than one extra hour under any circumstances.
(b) For the purpose of Schedule, a “Time Slot” shall mean a period not exceeding four hours. Transgressing the above time limit beyond 02.10 PM to 02:30 PM and 10:10 PM to 10:30 PM, as the case may be, will attract additional rent for half an hour. Similarly, in case the programme is finished after 02:30 PM to 3 PM or 10:30 PM to 11:00 PM, as the case may be, rent will be chargeable for one hour. GST will be chargeable extra as applicable. However, Show will not be allowed to run for more than one extra hour under any circumstances.
2.RESERVATION
  • (a) The party hiring the TAGORE THEATRE AUDITORIUM shall have to apply online on the website www.tagoretheatrechd.org.
  • (b)The booking for Tagore Theatre Auditorium can be got confirmed in advance not more than 90 days.
  • (c)Rehearsals in Tagore Theatre Auditorium cannot be thrown open to the public.
2 A) Hire Charges
  • (i) Full Payment of hire charges (Rent + GST + Security) shall be paid in advance at the time of the booking of TAGORE THEATRE AUDITORIUM through online or Demand Draft/ Pay Order payable at Chandigarh in favour of “TAGORE THEATRE SOCIETY”.
2 B) Security Deposit
  • (i) In addition to the payment of Hire Charges, the party will also deposit requisite security which shall be refunded (subject to deductions if any on account of damage to the property of Tagore Theatre Society, extra rent, etc.) on any working day, after two days of show/session. No interest will be paid on the security.
  • (ii) From the security amount deposited under above clause such sums shall be deducted as are needed to cover any dues, the cost of damage, if any, done to the Building, Furniture, Fittings, Electrical and other apparatus etc. during the use of the same by the party and the balance, if any shall be refunded to the party. The decision of the Director Tagore Theatre Society, in these matters shall be final and binding on the party concerned.
  • (iii) The Security amount of the party will be forfeited in case of any infringement of term & conditions laid down for Hiring of TAGORE THEATRE AUDITORIUM.
3. OBTAINING PUBLIC PERFORMANCE LICENSE FOR MUSIC FROM CONCERNED LICENSING AUTHORITY UNDER COPY-RIGHT ACT :
  • (a)No programmes shall be allowed in the Tagore Theatre, which would constitute an infringement of copyright of any individual or institution. If any such programme takes place without the knowledge and infringement comes to light later on, the party infringing the copyright shall be responsible for all consequences, legal or otherwise which follow. The Management of the Tagore Theatre Society shall be in no way responsible for the same.
  • (b)However, the attention of the party is invited to the instructions issued by the Govt. of India, Ministry of Human Resource Development, Department of Higher Education Copyright Division which, inter-alia, says that it is mandatory for the party to obtain such license(s) before performance of their Show in Tagore Theatre. It will be sole responsibility of the respective party to comply with all the requisite sections of the Copy Right Act at their own level, and a copy of the licence obtained from the competent authority be deposited with the Tagore Theatre Society at least four days before the Show Day, failing the Organiser will be solely responsible for the legal consequences that may arise under Copy Rights Act.
    As per decision conveyed to Tagore Theatre Society by the Legal Remembrance-cum-Director of Prosecution U.T. Administration, the organisations/ groups giving Public Performances or communication of the Music to the public by way of recorded Music or Live Performance or any words or any action intended to be sung, spoken or performed with the Music will have to pay the license fee to both PPL as well as IPRS, depending upon the kind of programme, as both are registered Societies under the provisions of the Copy Rights Act.     • The receipt of the payment made /NOC be shown to Assistant Director/Director Tagore Theatre before the show is performed.
  • 2. Payment to The Indian Performing Right Society Limited.
    • The license is to be obtained from “THE INDIAN PERFORMING RIGHT SOCIETY LTD. OFFICE AT S.C.O.35 (second floor) SECTOR--7--C. MADHYA MARG CHANDIGARH. Contact No.0172-2795930 Direct : +91 9417315930).
    • The receipt of payment made/NOC be shown to Assistant Director/Director Tagore Theatre Society before the show is performed.
4. USE OF TAGORE THEATRE AUDITORIUM
  • (a) The possession of the TAGORE THEATRE AUDITORIUM shall be given to the party not more than two and a half hours before the time fixed for the Show/Session. The party shall not retain the TAGORE THEATRE AUDITORIUM in its possession for more than half an hour after the completion of the show. If the party does not comply with this condition, Clause (a) & (b) under Rule 1 above will come into play and rent will be recovered accordingly.
  • (b) The Tagore Theatre Auditorium will be permitted to be used for programmes such as, Dance, Drama, Music by Amateur Artists and Organisations, Fashion Shows, Musical Nites, Theatre and Dance by Professional Artists, Film Star Shows, Auditions, Festivals, Shows by Govt. and Semi Govt. Organisations and Academies, Meetings, Non-Political Conferences, Seminars, Business Meetings, Shows of Schools, Colleges and Institutions. These Shows will be on such terms and conditions as are prescribed from time to time by the Management of Tagore Theatre Society. The Theatre will not be given for Political programmes and Religious functions.
  • (c)There are 801 seats in the Tagore Theatre Auditorium out of which 74 seats are in balcony. Extra chairing is not allowed in the Theatre. Accordingly, the party shall not allow over-crowding in the auditorium by inviting more persons than the 751 seats placed at its disposal in the Tagore Theatre Auditorium. The infringement of this rule shall compel the Management to forfeit the Security Deposit.
  • (d)Out of the 801 Seats of the auditorium, 50 (Fifty) seats as per details given below will be reserved for the Management of Tagore Theatre Society.

  • The Organiser shall hand over invitation cards/complimentary tickets for these 50 seats to Director, Tagore Theatre Society two days before the programme.
  • (e)Carrying of Eatables, Drinks, i.e., Cold Drinks, chips, snacks or any other eatable, Coffee, Tea, , etc. inside the Tagore Theatre Auditorium is forbidden strictly. As such, no Eatables or Drinks, etc. of any kind shall be allowed inside the theatre under any circumstances even to the Chief Guest or other VIP Guests and the party hiring the theatre shall be solely responsible for observation of these rules and it will ensure that all the restrictions are strictly adhered to under all circumstances, failing which the security deposit will be forfeited. Also no food of any kind (snacks or packed) brought from outside will be allowed to be served in the boundary of Tagore Theatre Auditorium and such items will have to be purchased from Tagore Theatre Cafeteria and should be consumed only in the Canteen area.
5. CANCELLATION /AND POSTPONEMENT CHARGES.
  • (a) In the event of booking being cancelled or postponed by the party hiring the Theatre for whatsoever reason, full Hire Charges deposited by it shall stand forfeited automatically by the Tagore Theatre Society.
  • (b) Director Cultural Affairs, U.T. Administration, Chandigarh or any other official who is authorised by her/him on her/his behalf, shall have the authority to cancel the permission for booking already granted to any party with the notice of ten days in case official government programme is fixed for the date so given to any organiser. In such an event the hiring charges (except GST) and Security Deposit received from the party shall be refunded or alternate date will be given. However, the decision of the Director Cultural Affairs, U.T. Administration, Chandigarh shall not be questioned and the party shall not be entitled to claim any damage or compensation whatsoever by reason of such cancellation.
  • (c) The Director Cultural Affairs, U.T. Administration, Chandigarh or any official who is authorised by her/him on her/his behalf will have the authority to cancel the permission already granted to any party without assigning any reason, if at any time after the granting of permission for the use of the Tagore Theatre Auditorium, the Director Tagore Theatre considers that it has reasons to believe that:
    • (i) The performance or the meeting, as the case may be, for which permission has been granted (a) is objectionable (b) transgresses or likely to transgress any of the Rules and Regulations relating to the use of the Tagore Theatre Society
    • or

    • (ii) The party has made a false statement regarding the scope and object of the performance / show/ meeting /conference then, Director Cultural Affairs, U.T. Administration, Chandigarh can cancel the booking in case of 4(c)(i) above and can inflict cancellation of booking for 4(c)(ii) with forfeiture of rent and security.
6. RECOVERIES FOR EXCESSIVE DAMAMGES
  • (a) The party hiring the theatre will be solely responsible for any losses, damages to the properties of Tagore Theatre while the Tagore Theatre Auditorium is in its possession.
  • (b) The Management of the Tagore Theatre Society will not be responsible for any losses, damages to the property of the Party, Artists or Audience during the performances.
  • (c) In case there is any losses, damages to the property of Tagore Theatre, the actual cost of the damage will be recovered from the security amount deposited and such amount shall be deducted as are needed to cover any dues, the cost of damage, if any, done to the Building, Furniture, Fittings, Electrical and other Apparatus, etc. during the use of the same by the party and the balance, if any shall be refunded to the party. The decision of the Director Cultural Affairs, U.T. Administration, Chandigarh, in these matters shall be final and binding on the party concerned.
  • (d)If the cost of damage done to the Building, Furniture, Electrical Apparatus, etc. referred to in clause 5(c) above is more than the security amount, the difference as determined by the Management of the Tagore Theatre Society shall be binding on the party and will have to be paid by the party under all circumstances in cash.
7. ADHERING TO LEGAL OBLIGATIONS

The applicant shall be solely responsible for :

  • (a) furnishing a certificate of exemption for sale of tickets, if the admission is by sale of Tickets from the Entertainment Tax Officer, Sector- 17, Chandigarh, seven(07) days before the date of performance of the Show and shall have to abide by all the regulations prescribed for such performance and be itself liable for any processing regarding any Tax, Fine, Penalty etc.
  • (b) Observing the rules and regulations enforced by the Chandigarh Police from time to time. They will have to intimate the Name, Address, Telephone Number, etc. of the VIP’s/ VVIP’s attending the show and of the Artists performing the show, seven (07) days before the performance of show to the SHO, Police Station, Sector – 19, Chandigarh and will finalize the seating arrangements of VVIP’s with police authorities, under intimation to the Assistant Director/Director Tagore Theatre Society.
  • (c) Observing the rules and regulations enforced by the Municipal Corporation, Chandigarh, from time to time, and any taxes if levied, will be the liability of the party hiring the theatre.
  • (d)Conducting all its programmes, and proceedings of the meetings or gatherings orderly and entirely lawfully and strictly within the scope of the objects for which the Tagore Theatre Auditorium is permitted. The party shall undertake all responsibility and the Management of the Tagore Theatre Society in no way, be held responsible in the matter.
8. PROHIBITIONS
  • (a)No Open Fire, Water Work, Inflammable Material, Smoke Effect, Weapons(Offence or Defence) will be allowed within the premises of Tagore Theatre or Green Rooms, etc. Under any circumstances.
  • (b)No Liquor, Drugs, smoking etc. will be allowed within the premises of Tagore Theatre under any circumstances.
  • (c)The party hiring the Theatre will not be allowed to drive nail on the Stage, Podium, Dice, Furniture or Wooden Pencils, Colouring on the Walls Fixing, Pasting on the Cyclorama, Wings, Curtains, Walls for decoration/publicity purposes, nor do any similar acts as would spoil, damage or disfigure the Tagore Theatre in any way. The party shall not also remove the furniture or other articles and fixtures from their original places.
  • (d)The party hiring the Theatre will ensure that they will not allow standing of persons in the Wings or Side Ramp of the Stage as can be visible to the Audience.
  • (e)The party hiring the Theatre shall not decorate the Main Hall or Main Gate with Flowers, Bunting, etc. within the premises of Tagore Theatre.
  • (f) Logos of sponsors are allowed to be displayed on Backdrop and Standee of the Programme Holders.
  • (g)The speakers will not be allowed in any part of the open space of Theatre premises except inside the auditorium.
  • (h)No music of any kind shall be played at the entrance nor shall loudspeakers be installed outside the entrance of the Tagore Theatre.
  • (i)The party hiring the Tagore Theatre Auditorium shall be held responsible for any unlawful and objectionable activities carried out by the artists and audience so invited by them in their programme.
  • (j)The party hiring the Theatre shall not allow any person to dance on the Chairs or in front of VIP Rows, under any circumstances.
  • (k)Spitting, Smoking, Drinking, committing nuisance of any kind or otherwise making any portion of Tagore Theatre or furniture, wall etc. dirty in any way or eating in hall is strictly prohibited in the Tagore Theatre. No Briefcase, Transistor, Bag, Tiffin Box, Camera, etc. will be allowed to be taken inside the Tagore Theatre and the party hiring the Theatre shall be responsible for following these rules and will ensure that the restriction is strictly adhered to under all circumstances.
  • (l)Rangoli with any type of material in any part in the Theatre will not be allowed under any circumstances.
  • (m)Any person other than Artists or members of organising committee will not be allowed on the stage or green rooms under any circumstances.
  • (n)The party hiring the Theatre shall not be allowed to dislocate or misuse the properties of the Tagore Theatre.
  • (o)Obscene/ foul language or anything hurting the sentiments of any cast or creed and anti-national activities will not be allowed on the stage. If, during the course of exhibition/ display of drama, etc. it comes to the notice that some obscenity was displayed, suitable action would be initiated by the Management of Tagore Theatre Society against such a party and when they apply for permission for another performance at subsequent dates, this aspect would be taken care of.
  • (p)The party shall ensure proper observance of all other terms & conditions prescribed in the Rules governing the use of Tagore Theatre that are binding on the party.
  • (q)The Catering (Breakfast, Lunch Dinner, Packed or Buffet) is not allowed inside the premises of the Tagore Theatre at any cost.
  • (r)Smoking is strictly prohibited in Tagore Theatre as it is a No-Smoking Zone. Any person found smoking in Tagore Theatre Campus, shall be fined Rs.300/- for every fault.
  • (s)No flower Decoration is allowed in any part of the Tagore Theatre including Stage, front of stage, outside walls, Glass Foyers etc.
9. GENERAL CONDITONS
  • (a)Selling of tickets, posting of ushers and management of entrance will be arranged by the party hiring the Tagore Theatre at their own level/cost.
  • (b)The Tagore Theatre is equipped with Lighting Equipment, PAE, Air Conditioning, Curtains, etc. for efficient services. Every effort shall be made to maintain the services in order, however, the Management of Tagore Theatre Society shall not be responsible for any failure or curtailment thereof.
  • (c) In case of electricity failure of Air Conditioners, the Management shall not be liable to pay any compensation to the Party.
  • (d)The Director Tagore Theatre Society or a person so authorised by him shall have full authority to enter any part of the Stage or Auditorium during the use of the same by the party.
  • (e)The party hiring the Theatre shall be responsible for maintaining the cleanliness inside and outside premises of Tagore Theatre under all circumstances and will put the unused articles in the dustbins provided in Tagore Theatre.
  • (f)The party hiring the Theatre will have to observe the rules and regulations enforced by the Management of Tagore Theatre Society under all circumstances.
  • (g)Display Board: Only standee of 6’ x 3’ is allowed to be fixed in the Tagore Theatre. This standees are allowed to display the logos of the sponsors.
  • (h)No show will be allowed in collaboration / association with any group / institution. If any group / institution organises a show in collaboration / association, in that case the higher rent shall be charged which is presently Rs.50,000/-
  • (i)If any group mentions the name of sponsors in the standee then the rent of Rs.2,000/- for open space and Rs.2,500/- for glass foyer shall be charged.
  • (j) If it is established at any stage that the booking has been made in the name of some other group but the show is organised by someone else, the booking shall be cancelled. The rent and security will also be forfeited.

Note: In case the time limit is crossed, fraction of an hour beyond 10 minutes to 30 minutes will be rounded off to half an hour and if the Rehearsal/Press Conference/Workshop continues beyond 30 minutes, then rent will be charged for full one hour.
11. APPEAL

Appeal against any decision of the Director Cultural Affairs or Director Tagore Theatre in connection with all the rules and regulations will lie with Secretary Cultural Affairs U.T Chandigarh and her/his decision will be final and binding.
